Terms & Conditions

These Terms and Conditions ("Agreement") are between Superhero Tec, owned by Ecropolis LLC, a company registered in Texas with registered address 8001 Valcasi Dr Ste 101, Arlington, TX 76001, USA ("Superhero Tec", "we" or "our") and you, and govern your use of the Superhero Tec services and website.

1. Definitions

  • Services: Website design and development services provided by Superhero Tec, including template customization, hosting, and additional services as specified in your Order Summary.
  • Starter Package: The basic service package offered by Superhero Tec.
  • Professional Package: The advanced service package offered by Superhero Tec.
  • Order Summary: The summary emailed to you explaining your selected package, price, and project details.
  • Start Date: The date at which your Services start, as specified on the Order Summary.
  • Astra Theme: The WordPress theme developed by Brainstorm Force, used as a base for our website designs.

2. Services

2.1 Superhero Tec agrees to provide you with the Services as set out in the Order Summary, subject to this Agreement.
2.2 You agree to pay for the Services from the Start Date at the rate set out in the Order Summary. Services are customized to meet your requirements, and Superhero Tec will not provide refunds unless the Services are not provided in accordance with this Agreement.
2.3 Superhero Tec offers two packages:
Starter Package ($299, excluding taxes):
  • Single page website
  • Mobile optimized
  • 10 high-quality licensed images
  • User-friendly page builder (CMS)
  • Interactive contact form
  • SEO ready
  • SSL certificate
  • 1 year free hosting
  • 1 revision
Professional Package ($599, excluding taxes):
  • Up to 5 pages
  • Custom domain included
  • Mobile optimized
  • 20 high-quality licensed images
  • User-friendly page builder (CMS)
  • Interactive contact form
  • SEO ready
  • SSL certificate
  • PayPal / Stripe payment integration
  • 1 year free hosting
  • 2 revisions
2.4 Both packages include 100% ownership rights to your website content and design, and a 100% satisfaction guarantee.
2.5 Additional revisions or services beyond those included in your package will be charged at an hourly rate of $150.
2.6 After the 1-year free hosting period, you will have the option to continue hosting with Superhero Tec for an additional fee or transfer your website to another hosting provider.

3. Payment

3.1 All payments are processed by third-party payment processors. Superhero Tec does not hold any credit or debit card details.
3.2 You agree to provide valid payment details and authorize the payment processors to bill you according to the terms set out in your Order Summary.
3.3 If you fail to pay any charges when due, the total amount for the full duration of the project will become immediately payable, and we may suspend the provision of Services until such monies are received.
3.4 All prices quoted are exclusive of any sales taxes.

4. Intellectual Property and Licensing

4.1 You grant Superhero Tec a non-exclusive, worldwide, transferable right to use, copy, modify, distribute, and publish any content you provide for the purpose of delivering the Services.
4.2 Upon completion of payment, you own the rights to your customized website content and design. However, the underlying Astra theme and its core features remain the property of Brainstorm Force. Your use of the Astra theme is subject to the GNU General Public License version 2.0 or later.
4.3 The Astra theme used in our services is licensed under the GNU General Public License version 2.0 or later. This open-source license grants you certain rights and responsibilities regarding the use and distribution of the theme.
4.4 You agree not to redistribute, resell, or offer the Astra theme or any of its components separately from the services provided by Superhero Tec.

5. Customer Content Ownership

5.1 You retain all rights, titles, and interests in and to the content you provide for your website. You grant Superhero Tec a license to use this content as needed to deliver our services to you.
5.2 You are solely responsible for ensuring you have the necessary rights to all content you provide and that it does not infringe on any third-party rights.

6. Client Responsibilities

6.1 You are responsible for providing Superhero Tec with all necessary information to complete the website design in a timely manner.
6.2 You warrant that any content you provide is accurate, up-to-date, and does not violate any applicable laws or regulations.

7. Updates and Support

7.1 Superhero Tec may provide you with updates for the customized aspects of your website. Updates to the core Astra theme are provided by Brainstorm Force and are subject to their terms and conditions.
7.2 Support for your customized website is provided by Superhero Tec. Support for core Astra theme functionality is provided by Brainstorm Force.

8. Data Protection

8.1 Superhero Tec will collect and process data in accordance with applicable data protection laws.
8.2 Tools used to hold and process information include Gravity Forms, ClickUp, and Stripe Payments.

9. Term and Termination

9.1 This Agreement commences on the Start Date and continues until terminated in accordance with these terms.
9.2 There is no capability to terminate the agreement once payment is processed, as this locks in your ability to receive a redesign based on your selections and information provided.
9.3 At the end of the 1-year free hosting period, you may choose to continue with Superhero Tec or terminate the relationship.

10. Limitation of Liability

10.1 Superhero Tec's total liability in connection with this Agreement shall be limited to the total amount paid by you for the Services.
10.2 Superhero Tec is not responsible for the quality or quantity of leads you may receive through the Services.

11. Governing Law

This Agreement is governed by Texas law and subject to the exclusive jurisdiction of the courts of Texas.

12. Changes to Terms

Superhero Tec may revise this Agreement from time to time. Any material changes will be notified to you by email.
